(iv) your violation of any applicable law or the rights of any third party.

You remain solely responsible for the contents of your luggage and shall be legally liable for any failure to comply with these Terms or applicable laws in connection with the Services.

To the maximum extent permitted by applicable law, The Luggage Cab shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, loss of data, or indirect property damage, arising out of or in connection with the use of the Platform or the Services, even if advised of the possibility of such damages.

Without prejudice to the foregoing, and subject to mandatory consumer rights, The Luggage Cab shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control.

In all cases, and to the extent permitted by applicable law, The Luggage Cab’s total aggregate liability to you in connection with the Platform, the Services, or any related booking shall not exceed USD 1,000 (one thousand United States dollars) per items, unless otherwise expressly stated under an applicable insurance add-on.

19. Bag / Personal Items Protection

The Luggage Cab may, at its reasonable discretion and subject to the limitations, exclusions, and conditions set out below, provide compensation for loss, damage, or theft of Items in connection with the Storage Service.

The Luggage Cab includes Bag Protection per Booking. As referenced in these Terms, Bag Protection applies to loss, damage, or theft of Customers’ Items while using the Services in connection with a Booking made through The Luggage Cab Platform. Bag Protection does not cover incidental or consequential expenses, including but not limited to transportation costs to or from Partners, additional accommodation, or alternative travel arrangements resulting from an inability to locate or retrieve an Item. Bag Protection is not an insurance policy and is provided at The Luggage Cab’s discretion, subject to applicable law.

Where a claim is deemed eligible under the Bag Protection (see Section 5.5), The Luggage Cab may compensate the Customer up to a maximum of USD 1,000 based on the original value of the Item, adjusted for reasonable depreciation. Replacement costs shall not be reimbursed. The amount of any compensation shall be determined by The Luggage Cab based on the evidence provided and the specific circumstances of the claim. The Luggage Cab reserves the right, acting reasonably, to deny claims, including in cases of suspected fraud.

Bag Protection does not apply to:

Items stored or handled outside of The Luggage Cab Platform;

Prohibited Items as defined in these Terms.

Items that are not properly packed or handled by the Customer, or that are inherently fragile or prone to damage, including but not limited to vases, glassware, artwork, photographs, liquids, or electronic devices without adequate protective casing, are excluded from Bag Protection.

Items deemed abandoned, including Items not retrieved by the scheduled end of the Booking, are excluded from Bag Protection. Where abandonment occurs, Partners may require Items to be shipped from Partner locations, and the Customer shall remain responsible for any applicable late pick-up fees and shipping costs in accordance with these Terms.

To be eligible for Bag Protection, Customers must:

Comply with these Terms;

Not have caused intentional or unlawful harm to The Luggage Cab’s reputation;

Not have received compensation from an insurer or any other third party for the same loss, damage, or theft. Customers must disclose any such communications or claims upon request. Failure to do so may result in denial of the claim.

Customers may be required to cooperate with The Luggage Cab, its Partners, affiliates, insurers (if applicable), and relevant authorities, including law enforcement, in the investigation and resolution of any claim.

Customers must hold a valid Booking for the Storage Service and provide proof of payment. Customers must further demonstrate that:

The Booking was made through The Luggage Cab Platform and all Partner interactions were conducted exclusively through the Platform;

Photographs of each tagged Item were taken at check-in, where required;

All applicable on-screen instructions were followed.

Failure to comply with these requirements may render the Customer ineligible for Bag Protection.

Customers must notify the assigned Handler and The Luggage Cab customer service of any loss, theft, or damage at the time of handover, and must submit a written notification to info@theluggagecab.com within twelve (12) hours of the scheduled conclusion of the Booking.

Customers must provide detailed information regarding each claimed Item, including its condition prior to storage, its condition upon retrieval (where applicable), and its declared value.

Customers must provide reasonable evidence that the Item was lost, damaged, or stolen while in storage as part of the Storage Service. Such evidence may include police reports, receipts, photographs, video footage, or other documentation reasonably requested. Failure to provide sufficient supporting documentation may result in claim denial.

Additional terms and conditions may apply where third-party insurance coverage is offered or involved, in accordance with the terms of the relevant insurance provider.
